1. Under Rule 26.03, subd. 19(6), Rules of Criminal Procedure, defendant must establish a prima facie case of jury misconduct before he is entitled to a post-trial hearing to impeach the verdict. On the facts of this case, the trial court did not abuse its discretion by refusing to grant such a hearing where defendant's motion was based on newspaper reports of interviews with several jurors and defense counsel's affidavit. 2. Although it was advisable for the trial court to instruct the jury that defendant's plea of not guilty was not evidence of his innocence, defendant was not prejudiced where the evidence that he committed the crimes charged was overwhelming.
